North Carolina Overtime Laws 2026
North Carolina follows standard federal overtime provisions. Employers must pay time-and-a-half (1.5x) for all hours worked in excess of 40 hours during a standard 7-day workweek.
Key Requirements:
- The 40-Hour Rule: 1.5x premium is required only when total weekly hours physically worked exceed 40. Daily overtime (over 8h in a day) is not required.
- Wage Payment and Benefits Act: Governs how and when wages must be paid, providing strict penalties for unauthorized pay cuts.
North Carolina's 24-Hour Wage Reduction Notice Rule
Under North Carolina General Statute § 95-25.13(3), employers must notify employees in writing of any reduction in wages or benefits at least 24 hours prior to the work being performed.
"An employer must provide employees with written notice of any reduction in wages or benefits at least 24 hours before the reduction takes effect. Retroactive pay cuts, or pay cuts implemented without prior notice, are strictly illegal under NC law."
If your employer reduced your wage from $18.00/hr to $15.00/hr without giving you a written notice 24 hours before you started working those hours, you are legally entitled to be paid at your previous rate of $18.00/hr for that entire pay period. Retroactive reductions constitute wage theft, and workers can recover double the unpaid amount in liquidated damages.
| Employer Action | Required Written Notice | Legal Status / Remedy |
|---|---|---|
| Wage Increase | None required (oral or written) | Fully Legal |
| Wage Reduction WITH 24h Notice | At least 24 hours prior written notice | Legal for future hours worked |
| Wage Reduction WITHOUT 24h Notice | No written notice, or notice given after work began | ILLEGAL retroactive pay cut. Employee must be paid previous rate. |
