The 40-Hour Rule (No Daily Overtime)
In Florida, non-exempt employees must be paid 1.5 times their regular hourly rate for any hours physically worked beyond 40 in a continuous workweek. Tipped Employees and Overtime in FL
Florida law allows employers to take a "tip credit" for hospitality and restaurant staff. Unlike many states where the tip credit varies, Florida Constitution explicitly mandates a strict $3.02 per hour tip credit. This number never changes, even as the overall minimum wage increases.
